01Acceptance of these terms

These Terms & Conditions ("Terms") are a binding agreement between you and Windowira, a brand of The Nelson M Group LLC ("Windowira," "we," "us"). They govern your use of windowira.com and related services, including email and text-message programs (the "Services"). By using the Services or submitting a form, you agree to these Terms, our Privacy Policy, and, if you opt in to texts, our SMS Terms. If you do not agree to them, you should not use the Services.

02What Windowira is, and is not

Windowira is an information service. We publish general, plain-language data about how clinical research works, how to read a study listing, what informed consent means, and which questions to ask a study team, and let visitors opt in to related updates. We do not give medical advice, diagnosis, or treatment, do not run, recruit for, or enroll people in clinical studies, and do not match or refer people to studies or research sites, and we never share your details with study sponsors, research sites, recruiters, pharmaceutical or device companies, lead-generation companies, or any other third-party partners.

• Decisions about your health and about taking part in any research are yours. Reading our content does not obligate you to do anything.
• Your doctor and the study team, not Windowira, decide whether a study is right for you and explain its risks, procedures, and conditions.
• Every study is different. We do not guarantee that any study is safe, suitable, or open to you, or that you will qualify for or benefit from any research.

03Eligibility

The Services are open to people who are at least 18, are located in the United States, and can legally enter a binding contract. Please submit details only about yourself, or about another person who has authorized you to share them.

04Your information and accuracy

The information you give us must be accurate and current, and you agree to correct it when it changes. Provide only a mobile number that belongs to you or that you are authorized to use. If your number changes or is reassigned, please reply STOP from the old number or contact us so that we do not message someone else.

05Communications and text-message consent

When you opt in, you agree that email and, if you check the relevant boxes, automated text messages might be used to contact you as described in the SMS Terms. Consent to texts is optional, is not a condition of purchase or of using the Services, and may be withdrawn at any time by replying STOP. Message frequency varies. Message and data rates may apply. Reply HELP for help.

06Text messaging: rates, frequency, STOP and HELP

Message and data rates may apply. Message frequency may vary (up to about 8 messages a month, depending on the topics you choose). Text START to join, or opt in with the form on our Get Started or text updates page. Consent is not a condition of purchase or of using the Services.

• STOP: Reply STOP to any message to opt out (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will get one confirmation text and then no more messages.
• HELP: Reply HELP to any message for help, or contact us by email at [email protected] or by phone at 877-551-0031.

Mobile information and opt-in data are not sold or shared with third parties or affiliates for marketing or promotional purposes. See the Privacy Policy and SMS Terms.

07Acceptable use

In using the Services you agree that you will not (a) provide false, misleading, or someone else's data, (b) engage in unlawful, fraudulent, or abusive conduct, (c) interfere with, disrupt, or try to gain unauthorized access to the Services, (d) use bots or automated methods to submit forms, (e) copy, scrape, or resell our content without permission, or (f) impersonate any person or entity. We may suspend or end access for violations.

08Third-party organizations and links

Organizations, programs, and products mentioned on or linked from the Services (for example government agencies, hospitals, or patient organizations) are third-party operations. No product, plan, or provider is endorsed by us, and we have no responsibility for the conduct, content, or results of those third parties. Your relationship with any doctor or study team is between you and them.

09Intellectual property

The Services, including the Windowira name, logo, text, graphics, and design, belong to us or our licensors and are protected by intellectual property law. You receive a limited, revocable, non-exclusive, non-transferable license to view and use the Services for personal, non-commercial purposes. Photographs on the Site are used under their own free-use licenses.

10Disclaimers

No warranties of any kind, express or implied, apply to the services or content, which are supplied "as is" and "as available." This includes implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We also do not warrant that the services will be uninterrupted, error-free, or secure, or that any message will be delivered on time or at all.

Windowira does not offer financial, legal, or tax advice, and makes no representation about any medical outcome, study result, or eligibility.

11Limitation of liability

To the maximum extent the law permits, Windowira and The Nelson M Group LLC, and their members, managers, officers, employees, and agents, will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the services, or from any health or research decision you make or do not make. Our total liability for any claim relating to the services will not exceed one hundred U.S. dollars ($100).

Certain jurisdictions do not permit some limitations, so part of the above may not apply to you. These Terms do not limit any liability that the law does not allow to be limited.

12Indemnification

You agree to indemnify and hold harmless The Nelson M Group LLC and its affiliates and personnel from claims, damages, and expenses (including appropriate attorneys' fees) arising from your violation of these Terms, your misuse of the Services, or your provision of a phone number or other information that you were not authorized to offer.

13Disputes, governing law, and arbitration

Informal resolution first. Please contact us at [email protected] so that we have 30 days to try to resolve it.

Binding arbitration. Except for small-claims matters and claims for injunctive relief for intellectual-property misuse, any dispute between you and Windowira or The Nelson M Group LLC arising out of or relating to these Terms or the Services will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration will be conducted in your county of residence or by video or phone, at your choice. The arbitrator may award the same individual relief as a court, and judgment may be entered in any court of competent jurisdiction.

Class-action waiver. As permitted by law, each of us, you and Windowira, will bring claims only on an individual basis, and not as a plaintiff or class member in any class, collective, or representative proceeding.

Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing [email protected] with "Arbitration Opt-Out" as the subject, and tell us your name and mobile number.

Governing law. These Terms are governed by the Federal Arbitration Act and to the law of the state of The Nelson M Group LLC's principal place of business, disregarding conflict-of-law rules. Other than as the arbitration clause supplies, courts of that state, state and federal, have exclusive jurisdiction.

14Termination

You may stop using the Services at any time, and may opt out of messages by replying STOP. Violations of these Terms, among other things, may lead us to suspend or terminate access at our discretion. Sections which by their nature should survive termination (including disclaimers, limitation of liability, indemnification, and disputes) will.

15Changes

We can amend these Terms by posting a new version with a new "Last updated" date; if you retain using the Services after the effective date, you accept the amended Terms. We will give legally needed notification of material changes.

16General

You and we agree that these Terms, together with the Privacy Policy and SMS Terms, are the complete agreement on this subject. If any part cannot be enforced, the rest stays in effect. A waiver only occurs if we say so; failing to enforce is not one. You may not assign these Terms without consent, and we may assign them in a merger or sale.
